The present general conditions of sale apply to all orders placed with the company Maison Marcel for all articles and services offered on the website https://www.maisonmarcel.shop/en/ by non-trading individuals. Consequently, the fact that any person orders a product offered for sale on the Maison Marcel website implies full and complete acceptance of these general conditions of sale, which the Customer acknowledges having read prior to ordering. Maison Marcel reserves the right to modify the present general conditions of sale at any time. Nevertheless, the General Conditions of Sale applicable to the order placed by a Customer on the Maison Marcel website are those accepted by the Customer at the time of placing the order.

ARTICLE 1: COMPLETENESS

The present General Conditions express the entirety of the obligations of the parties. In this sense, the Customer is deemed to accept without reservation the entirety of the provisions set out in these general conditions of sale. Maison Marcel commits itself to respect its role as a retailer within the framework of the said conditions.

ARTICLE 2: PURPOSE

The purpose of the present General Conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company Maison Marcel to the Customer, from the order to the delivery, through the payment and the use of services made available by Maison Marcel.

ARTICLE 3: SCOPE OF APPLICATION

The present General Conditions govern the sale of products on the day the order is placed by the customer. They apply to all methods of placing orders offered by Maison Marcel.

ARTICLE 4: ORDERING

CAPACITY TO CONTRACT

All Customers declare that they have the capacity to contract under the conditions described below, i.e. that they are emancipated minors or have reached the legal age of majority and that they are not protected within the meaning of Article 488 of the Civil Code.

Maison Marcel reserves the right to refuse any Order from a Client with whom a dispute exists or arises during the processing of an Order, in particular a payment dispute.

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER

The present Conditions can be read directly on the website https://www.maisonmarcel.shop/en/. On simple request of the Customer, they can also be sent by e-mail.

The fact that the Customer ticks the box "I HAVE READ THE GENERAL TERMS AND CONDITIONS OF SALE AND I AGREE WITHOUT RESERVATION", before proceeding with the secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in the present general terms and conditions of sale under the paragraph "right of withdrawal". The Customer acknowledges by this act to have read and understood the present Conditions and to accept them.

ORDER PLACEMENT

The individual Customer can place his order with Maison Marcel by internet on the site accessible at the address https://www.maisonmarcel.shop/en/. The ordering process is composed of 6 successive steps. Once the selection of products has been made, and the basket validated, the Customer must :

- clearly identify the selected products with the options of colors, sizes, ... indicated on the site https://www.maisonmarcel.shop/en/;

- indicate the quantities requested ;

- identify himself either by entering his email address and password which are strictly personal, or by mentioning all the information usually requested for an online registration;

- clearly indicate the information necessary for delivery. This applies in particular to the exact delivery address and any accessibility restrictions of the delivery location (building, floor, code, etc.);

- indicate the delivery method chosen;

- indicate the chosen method of payment. Once the method of payment has been selected, the Customer must proceed with the payment of his order on the secure interface, which will formalize in a firm and definitive manner the sales contract between him and Maison Marcel.

Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will intervene within the framework of a possible exchange and the guarantees mentioned below.

In all cases, the online provision of the credit card number and the final validation of the order by the Customer will be considered as proof of the order and the payment of the amounts for the products selected in the order. ORDER CONFIRMATION

An e-mail is automatically sent to the customer to confirm the order, provided that the e-mail address indicated in the registration form does not contain any error.

The Customer must verify the completeness and the conformity of the information he provides to Maison Marcel. Maison Marcel shall not be held responsible for any typing errors and the consequences in terms of delay or error in delivery. In this context, all expenses incurred for the reshipment will be charged to the Customer.

ORDER TRACKING

The Customer may at any time consult the status of his order by consulting the "My account" section on the https://www.maisonmarcel.shop/en/ website. This follow-up allows the Customer to know the state of processing of his order, but also the state of dispatch or delivery of his packages. This last follow-up of delivery is carried out in interface with the Internet means of follow-up of the carriers. Maison Marcel cannot be held responsible for the unavailability or errors that may affect the information provided by its carriers. Nevertheless, Maison Marcel makes every effort to make this information as clear as possible and to make the transport with its carriers as reliable as possible. The Customer may at any time contact the customer service of Maison Marcel in order to be informed of the follow-up of his order.

PROOF OF ORDER

The computerized registers, kept in the computer systems of the company Maison Marcel in reasonable conditions of security, will be considered as proof of the communications, orders and payments made between the parties.

The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

ARTICLE 5: PRODUCT INFORMATION

PRODUCT FEATURES

The information, characteristics, photographs and graphics presented on the sites or in the e-mails sent by Maison Marcel are presented with the greatest possible accuracy. Each Product sheet is written from the information provided by the manufacturer or supplier of the Product, and presents the essential characteristics of the selected Product in accordance with article L.111-1 of the consumer code. This information is intended, without being exhaustive, to inform the Customer as fully as possible about the essential characteristics of the Products. The Customer is informed, subject to his rights, of the possibility of a difference in presentation at the time of delivery resulting from a change in packaging (photography and illustrations) by the manufacturer or supplier, this difference not affecting in any way the content and characteristics of the Product.

PRODUCT AVAILABILITY

Maison Marcel will only honour orders received within the limits of available stocks of products. In the event that the Product(s) are not available, Maison Marcel undertakes to inform the Customer as soon as possible. The availability may vary during the same day depending on the level of sales. Maison Marcel updates the availability very frequently. In case of unavailability of products, Maison Marcel will inform the Customer by telephone or by e-mail.

The unavailability of a product is mentioned on the page of the product concerned.

If Maison Marcel cannot obtain a product ordered, the company will notify the customer of the expected delay by e-mail. The latter may then request a refund of the sums paid within 14 days of their payment, or the exchange of the unavailable product for another product, or the cancellation of the order. No cancellation penalty will be applied for such an order cancellation. No compensation for cancellation (apart from a full refund of the Order) may also be requested, as such unavailability results from the time taken to update such unavailability.

Maison Marcel shall not be held responsible for the non-execution of the contract concluded in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding, fire.

ARTICLE 6: PRICES

The prices are indicated in euros, inclusive of all taxes, and are only applicable on the date the order is validated by the Customer. The prices of Maison Marcel's suppliers being in constant evolution, the prices displayed on the site are likely to be modified at any time.

The prices do not take into account delivery costs, possible promotional offers and personal discounts, indicated before the final validation of the order.

The prices take into account the French VAT applicable on the day of the order and any change in the legal rate of VAT will automatically be reflected in the price of the products presented on the site, on the date stipulated by the implementing decree. However, the prices cannot be modified once the Customer's order has been placed. Similarly, if one or more taxes or contributions, particularly environmental taxes, were to be created or modified, either upwards or downwards, this change could be passed on to the selling price of the items on the site https://www.maisonmarcel.shop/en/.

Orders to countries outside the European Union are not subject to French VAT. The prices indicated on the site for these orders are exclusive of tax and therefore do not take into account the VAT. However, these orders are subject to any taxes and customs duties of the country of destination.

The customer is also responsible for checking the importability of the ordered products according to the law of the country of delivery. We recommend to contact the Customs Service for more information.

ARTICLE 7: PAYMENT

MEANS OF PAYMENT

The Customer can pay his order on line by credit card (Carte Bleue, Visa, Eurocard-Mastercard and E-carte bleue) or by PayPal. The Customer guarantees the company Maison Marcel that he/she has the necessary authorizations to use the method of payment chosen by him/her, when validating the order form.

Purchases are debited from the customer's account at the time the order is processed. Maison Marcel uses all necessary means to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure mode of payment SSL (Secure Socket Layer) which allows the encryption of your bank details during their transmission on the network. You can see that the transmission is encrypted by software when the padlock symbol appears in your browser. The transaction is carried out via the Crédit du Nord bank, which alone has the banking information provided on the site at the time of payment. The company Maison Marcel reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card from the officially accredited organizations or in case of non-payment.

The company Maison Marcel reserves the right to refuse to make a delivery or to honour an order from a Customer who has not paid in full or only partially for a previous order or with whom a payment dispute is being administered.

Within the framework of a procedure of verification of the orders intended to ensure that no person uses the banking co-ordinates of another person without his knowledge, it could be asked to the Customer to address by fax or electronic mail to the company Maison Marcel a copy of an identity paper as well as a proof of residence. The order will be validated only after reception and verification by our services of the documents sent. In the absence of reception of these documents within 15 days following the placing of the order, the latter will be considered cancelled by right.

INVOICE

The order form that the Customer establishes online or the order confirmation sent by e-mail to the Customer by Maison Marcel does not serve as an invoice. The Customer has the original invoice in his online account. The invoice is not attached to the package.

Maison Marcel keeps an electronic copy of each invoice.

In the case of a delivery to an address different from the billing address, the invoice is in any case only available in the online order tracking of the Customer's account.

TRANSFER OF OWNERSHIP

Maison Marcel remains the owner of the delivered Products until their complete payment by the Customer. The above provisions do not prevent the transfer to the Customer of the risks of loss or deterioration of the Products subject to the retention of title as well as the damage that they may cause, as soon as the Products are delivered.

DELIVERY SERVICES

The products are delivered to the address indicated by the Customer on the order form. The Customer must verify the completeness and conformity of the information he/she provides to Maison Marcel. Maison Marcel shall not be held responsible for any typing errors and the consequences in terms of delay or error in delivery. In this context, all costs incurred for the reshipment of the order will be entirely at the expense of the Customer.

Maison Marcel cannot be held responsible for delays in delivery due to errors or disturbances attributable to the carriers (including in particular in the event of a total or partial strike of the postal services and means of transport and/or communications).

SHIPPING TIMES

Orders placed online via the site https://www.maisonmarcel.shop/en/ are collected every day from Monday to Friday, except on public holidays. Maison Marcel does its utmost to process and ship the same day any order placed before 11am, nevertheless the processing and preparation time of an order may be extended depending on the items and last between 1 and 2 working days. Upon receipt of the shipping confirmation email, the Customer can take into account the delivery times of the carriers announced below.

Maison Marcel informs its Customers that these delivery times do not include Saturdays, Sundays and public holidays.

An e-mail is automatically sent to the Customer at the time of shipment of the Products provided that the e-mail address indicated in the registration form does not contain any error.

SHIPPING DEADLINES

Transport times depend on the carrier chosen by the Customer and the place of delivery.

Maison Marcel informs the Customers of the delivery times announced by the chosen carrier. The shipping costs are calculated according to the country of delivery at the time of the shopping cart and are definitively confirmed according to the mode of transport and the delivery destination chosen, before the final validation of the order.

However, Maison Marcel informs its Customers that the announced deadlines do not include Saturdays, Sundays and public holidays.

DELIVERY TIME

The delivery time is equal to the time indicated at the time of the order in the delivery method section.

MEANS OF DELIVERY IN METROPOLITAN FRANCE

Delivery by Mondial Relay (usually 5 days)

Delivery is made to the relay point selected by the customer within 3 to 5 days. The carrier will notify the customer as soon as the order is available at the relay point.

Standard delivery by Colissimo (usually 48 hours)

This method of delivery allows the Customer to receive his parcel within 48 hours from the time of shipment thanks to the Post Office and the Colissimo service (excluding the time required to process and prepare the order, which may take from 1 to 2 days). Deliveries are made from Monday to Saturday morning, except on public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered.

The parcel is picked up by the Post Office and delivered to the delivery address indicated by the Customer. In case of absence at the time of delivery, a notice of passage is left at the delivery address indicated by the Customer, which allows the latter to withdraw his parcel in the nearest post office. The packages are kept pending at the Post Office for 15 calendar days. In case of non withdrawal within the time limit set by the carrier, the products will be returned to Maison Marcel who reserves the right to reimburse the price of the products, the shipping costs remaining the responsibility of the Customer.

Withdrawal from the Maison Marcel boutique (usually 24 hours)

The withdrawal is made at the Maison Marcel shop located at 970 Rue nationale, 69400 Villefranche-sur-Saône during the opening hours (Monday to Friday from 8:30 am to 7 pm and Saturday from 8:30 am to 6 pm. Closed on Sundays) during the day or within 24 hours following the order if the product is not in stock at the shop. The customer will be notified by email as soon as the order is available in the shop.

MEANS OF DELIVERY OUTSIDE METROPOLITAN FRANCE

In Europe and abroad, delivery is made via Colissimo. The costs incurred depend on the country of destination, the weight and the total volume of the selected items. The costs and times are indicated to the Customer before the final validation of his order.

Orders to countries outside the European Union are not subject to French VAT. However, they are subject to possible taxes and customs fees in the country of destination. These costs and related formalities are the responsibility of the customer/consignee. They are to be paid directly to the carrier at the time of delivery. The customer is also responsible for checking the import possibilities of the ordered products with regard to the law of the country of delivery.

PACKAGING

The products are packaged in such a way as to comply with current transport standards, and to ensure optimum protection of the products during their delivery. The Customer is asked to respect these same standards when returning a product, whether it is for after-sales service or for a return for convenience. In case of a return of a product, if we notice that the product is damaged due to insufficient packaging, Maison Marcel may decide to reimburse only part of the product or to refuse to reimburse it if it is impossible to resell it in its original state.

RESPONSIBILITY OF THE CUSTOMER TO CHECK THE PACKAGES UPON RECEIPT

Maison Marcel reminds the Customer that it is the responsibility of the Customer to inspect his parcels upon receipt in the presence of the delivery person and to immediately notify the carrier and the Maison Marcel customer service of any anomaly noted (shock, damaged parcel, delivery date not in accordance with the normal delivery service deadlines. In the event that such information is not mentioned on the delivery slip presented to the Customer by the carrier, no claim relating to the condition of the package(s) can be accepted a posteriori by Maison Marcel.

CARRIER-RELATED DELIVERY DELAYS

In the case of a delay in delivery in relation to the deadlines announced by the carriers, the Customer must first contact the carrier or its distribution office in the case of the Post Office, to see if the package is not pending. If necessary, the Customer may contact the Maison Marcel Customer Service by e-mail in order to open a dispute file or an investigation to search for the package.

It happens that packages are lost by the carriers. The delays imposed by the carriers imply that the Customer declares the loss within 10 days following the reception of the shipping notice from Maison Marcel. Under these conditions, Maison Marcel will make the necessary claims to the carrier concerned. Once the claim and the opening of an investigation have been made, it may take 3 to 4 weeks to receive a return from the carrier.

If the parcel is found, it will be immediately sent back to the Customer's home. In the event that the package is not found, the Customer may then request the return of the same product (within the period of availability), at the expense of Maison Marcel, or the reimbursement of the amount paid. If the product(s) ordered were no longer available at that time, Maison Marcel will refund the amount of the products concerned by the loss of the carrier.

DAMAGED PACKAGES

The Customer must check the condition of the package in front of the carrier and make the necessary reservations on the delivery slip in the event of partial or total deterioration. In the absence of reserves, the product is considered accepted by the Customer and cannot be the object of any dispute concerning its delivery. The Customer must inform Maison Marcel by e-mail as soon as possible, so that Maison Marcel can take the necessary measures as soon as possible.

ARTICLE 9: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

9.1 Legal withdrawal period

In accordance with the provisions of articles L.221-16 and following of the Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the Articles to exercise his legal right of withdrawal and to inform Maison Marcel of his intention to return the said Article. If the Articles can be the object of the legal right of withdrawal, the Customer exercising his right of withdrawal under the conditions provided for in the present article in terms of time and methods of return of the Articles, will be able to obtain a refund of the Articles returned. Form available in CGV Article 9.4.

The refund will be made by the same means of payment as the one used by the Customer for the initial transaction, unless the Customer specifically requests a credit note, valid for six (6) months from its issue. The refund will be made as soon as possible and at the latest within 14 days following the effective exercise of the right of withdrawal by the Customer. This period may however be extended by Maison Marcel until Maison Marcel receives the goods returned by the Customer to the address indicated on the return form, or until Maison Marcel receives proof of shipment of the Articles by the Customer.

Where the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it shall be extended to the next business day.

In accordance with Article L.221-23 of the Consumer Code, the right is exercised by returning the Article, only the shipping costs remain payable by the Customer.

The right of withdrawal shall be exercised under the same conditions from the time of the Order and before Delivery.

9.2 Items excluded from the statutory withdrawal period

In accordance with Article L.221-28 of the French Consumer Code, the Customer does not have the right to return an Order for Items which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly. This applies in particular to goods whose original packaging has been unsealed, including any cosmetic item that has been opened or damaged, by the Customer after delivery, as they cannot be returned for reasons of hygiene and health.

9.3 Period of withdrawal by agreement

In order to ensure the satisfaction of its Customers, Maison Marcel accepts the return by post to the address indicated by the Customer Service or on the delivery slip of the Article concerned, within a period exceeding the aforementioned legal period of retraction. In this respect, the Customer has fourteen (14) days from the date of receipt of his order to withdraw and return his Items. The return of items beyond this period will not be accepted.

9.4 Terms and conditions for exercising the right of withdrawal

Maison Marcel suggests to the Customer to return the products by registered mail or with an additional insurance, guaranteeing him, if necessary, the compensation of the products up to their real market value in case of spoliation or loss of these goods. In all cases, the return is at the Customer's risk. It is up to the customer to keep all proof of return. The return costs are at the expense of the customer, who is free to choose the shipping method.

In the absence of respecting the deadlines mentioned, Maison Marcel will not be able to reimburse the Customer.

Only items returned in their original packaging in perfect condition for resale (shoebox, plastic bags, etc.) will be accepted. Consequently, returns of washed and/or worn clothes, as well as damaged boxes will be refused.

The withdrawal can never be exercised if the Articles delivered are Articles that have been, even partially, washed, soiled, damaged or used. Similarly, these Articles returned incomplete, damaged or soiled by the Customer will not be returned or exchanged.

The Articles must also be accompanied by the order number.

The Customer's responsibility can only be engaged in the event of depreciation of the Article resulting from handling other than that necessary to establish the nature, characteristics and, where appropriate, the proper functioning of the Articles.

The refund in case of use of the right of withdrawal will be made by the same means of payment as the one used by the Customer for the initial transaction, unless specifically indicated by the Customer.

ARTICLE 10: GUARANTEES, CLAIMS AND MEDIATION

Guarantees

In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof shall not deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the item sold.

The Customer is expressly informed that Maison Marcel is not the manufacturer of the products presented on the website https://www.maisonmarcel.shop/en/, in the sense of the law n°98-389 of May 19, 1998 and relative to the responsibility for defective products.

Consequently, in the event of damage caused to a person or property by a defective product, only the responsibility of the manufacturer of the latter may be sought by the Customer, on the basis of the information appearing on the packaging of the said product. Furthermore, the company reminds the Customer that the products, services and information offered by Maison Marcel do not in any way substitute for the vigilance of adults at all times.

Maison Marcel cannot be held responsible in case of non-respect of the legislation of the country where the products are delivered. It is up to the customer to check with the local authorities the possibilities of importing or using the products or services that you are planning to order.

Where applicable, the reimbursement shall be made within 14 days of receipt of the Article by Maison Marcel according to the method of payment chosen at the time of the Order, either on the bank card used for payment, or on the Customer's PayPal account. These provisions are not exclusive of the aforementioned right of retraction.

ARTICLE 11: LIABILITY

The products offered are in conformity with the French legislation in force and the standards applicable in France. Maison Marcel cannot be held responsible in case of non-respect of the legislation of the country where the product is delivered. It is up to the Customer to check with the local authorities the possibilities of importing or using the products that you are considering ordering.

Maison Marcel cannot be held responsible for inconveniences and damages related to the use of the internet network such as a break in service, the presence of computer viruses or external intrusions and more generally all cases qualified as force majeure or third party acts by the courts. Maison Marcel declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.

ARTICLE 12: FORCE MAJEURE

Neither party shall have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure.

Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all efforts reasonably possible.

The party affected by such circumstances shall notify the other party within ten working days of becoming aware of the circumstances.

The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued.

If the case of force majeure lasts for more than three months, these general conditions may be terminated by the injured party.

It is expressly stated that, in addition to the usual cases of force majeure or fortuitous events, the following are considered to be cases of force majeure or fortuitous events, as defined by the jurisprudence of the French courts and tribunals
